Someone who has just been in an accident has a new list of stresses and worries. They are thinking about their injuries, medical expenses, missed time at work, getting their car fixed, and how much is it all going to cost. One of the next questions sounds like: "I need a lawyer, but lawyers are expensive. How am I going to pay for a lawyer?" Fortunately, some lawyers have decided to take care of that concern by offering their services for a "contingency fee". Next Question: "What's a contingency fee"? A "contingency fee" is where a lawyer agrees to represent a client and the lawyer only gets paid if the case is successful. While the case is going on, the lawyer does the work without billing the client and pays all of the expenses of litigation. If the case is successful and money is recovered, the attorneys' fees and case expenses are paid out of the recovery at the end. This arrangement is risky for the lawyer because recovering money in a personal injury case is NEVER guaranteed. There are a number of factors that affect whether an injured person will recover money, and if so, how much. With a contingency fee agreement, the lawyer bears this risk for the client and invests the firm's own time and money so the client doesn't have to. This "contingency fee" arrangement is critical because it allows an injured person to get the representation they need even if they don't have the money to pay for a lawyer. The contingency fee also assures the client that her attorney will work hard to achieve the best possible result because the better the result, the better it is for both attorney and client. At Chaffin & Homan, we have been representing our clients on a "contingency fee" basis for over 40 years.
